Letters to the Editor: DEC Needs All the Information

To the Editor:

More thoughts on the Department of Environmental Conservation's (DEC) letter about the closed landfill where the current DPW building is located:

The letter from the DEC, which the mayor answered immediately, included this sentence: "Inactive landfills which are not impacting the environment and were closed in accordance with the regulations in effect at the time during which they last operated are not regulated unless they are excavated, encroached upon or otherwise disturbed. Post-closure uses and site developments on inactive municipal solid waste landfills raise concerns for public health/safety and the environment and may only be undertaken after written authorization has been granted by this Department."

At last night's Board meeting we saw photos of piles of landfill (not, as stated in the Mayor's letter, “trees and branches”) which was dumped in Pagenstecher Park at the time the DPW building was constructed in 2005. We heard that complaints about this dumping had been printed in the Local as well as brought to Board meetings and were reflected in minutes of those meetings. I'm concerned that the Mayor did not have accurate information to respond to the DEC letter, and therefore mis-informed the DEC in his response.

At last night's meeting I also asked if the DEC had given written authorization for building the DPW building as the law requires. In answer, Deputy Mayor Edsall reminded me that many of the documents, plans, etc concerning the construction of the DPW were missing, so it would be impossible to answer that question.

So the DEC will have to tell us whether or not they granted permission for the 2005 DPW construction on the landfill, with its toxic waste.

I assume this letter and the other from Mr. Argenio have been forwarded to the DEC; it seems it would be a citizens duty
