To the Editor:
In the last couple of weeks I have been written about concerning an affidavit which I provided for the Auffredou Article 78 vs. the Village. In this regard, I would like to explain.
First of all, I am not suing the Village. I have provided an affidavit, my sworn statement of fact under penalty of perjury. An affidavit is not my opinion, it is my statement of facts surrounding the case. As you may recall, I voted against the appointment of the new treasurer, but this had nothing to do with my affidavit. I was asked to provide it to counsel and as a member of government, feel it is my responsibility to have a transparent office. As part of the upcoming lawsuit, I may very well be deposed, as I expect the rest of the Board will have that opportunity to express their opinions of the facts in this case. However, I chose to respond to counsel’s request with an affidavit.
Secondly, at the Village Board meeting on August 15 there was a resolution to appoint the Village Attorney to respond to the Article 78. I recused myself so there would be no possible thread of political or prejudicial bias. I felt, and continue to feel, strongly that this was the right thing to do, given my position on the board and my involvement in the case.
I also have been criticized for questioning legal expenses and now participating in this litigation. This would be like haggling for the cost of a new car and then refusing to drive it after the purchase: the events are exclusive of each other. I fail to see a connection between them.
However, the fact still remains that we are paying for legal expenses for general village legal affairs that could have more wisely negotiated in a fixed retainer. As long as those expenses continue to mount, I will continue to question the expenditure. I continue to fight for fiscal responsibility in all village expenditures. Thank you.
