General News: Owner Appeals for Moratorium Exemption

The owner of the former Star warehouse property off Route 32 in Mountainville appeared before the Cornwall Town Board on Monday to ask for a hardship waiver from the town’s current moratorium on new building permits.
Owner Zigmond Brach told the town board that he would like to expand the 180,000 square foot warehouse on Industry Drive to make room for goods that had been stored in a company warehouse in California that had a fire. Brach and his architect, Vince Pietrzak, showed the board plans for a 50,000 square foot addition to the existing building.
Brach told the board that currently the warehouse maintains an inventory of electronics, perfume and furniture. He said that his company, Pyramid Audio, a manufacturer and distributor of car stereo equipment in California, would combine its activities in an expanded Mountainville facility.
Shortly after the town imposed a moratorium on new building permits, Brach applied with the planning board for the expansion permit. He said that an application for a hardship exemption to the moratorium was filed on December 30th. “This thing shouldn’t drag out, it should just be what planning board does,” Brach told the board, noting that changes are limited to the driveway and loading dock, with no new employees expected to be hired.
Town attorney Steven Gaba pointed out that the owners must prove that a hardship would be created if they are not allowed to get a building permit before the moratorium expired, which is now scheduled to occur in September 2011. “It has to be more than ‘Gee, this would be a tough break for my project if I didn’t get an exemption,’” Gaba said.
The board is now reviewing the application and is expected to make a decision at its April meeting.
