General News: Board of Elections Certifies Village Vote

The Orange County Board of Elections has certified the vote count from Tuesday’s election, calling incumbent Mark Edsall and challenger Andrew Argenio the winners of the trustee race.
Village of Cornwall-on-Hudson clerk Jeanne Mahoney said that on Wednesday representatives from the Orange County Board of Elections confirmed the count she had taken the night before, which placed Argenio with 487 votes, one vote more than incumbent trustee Douglas Vatter and challenger Jan smith who tied with 486 votes. Edsall was the only clear winner in the race with 497 votes.
However, Vatter sent a letter to Mahoney and the board of elections expressing his intent to challenge the board’s decision. In his letter, Vatter states that an absentee ballot came to village hall in the mail Wednesday morning from his son, which he believes should be counted because it was mailed five days before the election.
After learning of the appeal, board of elections commissioner Susan Bahren said the ballot will be discounted. Barhen said that according to Article 15, section 120(6) of the New York state election law the envelope that is sent out with a the absentee ballot clearly states that the ballot must be returned before polls close on election day.
In his letter Vatter contends that that the section only deals with how the envelopes for the absentee ballots should be printed and how the votes are counted.
Vatter also asked that any absentee ballots that have arrived after March 15 to be saved so he may use them to contest the board of election’s ruling.
Argenio was present for the recount and said that Vatter’s challenge was unfortunate.
“I believe and trust the opinion of the Orange County Board of Elections,” said Argenio. “We’ve had enough lawsuits and litigation for one village.”
