To the Editor:
As I am sure most of this site’s readers are aware, the latest desperate act of the Mayor Gross has been to file an Article 78 lawsuit against Trustees Kane, Edsall, Vatter and the Village itself. The fact remains that the Mayor refuses to, nor has the ability to, work with any Board majority unless that majority is toeing the line for him and his personal agenda.
As it turns out, in 2008 and 2009, the Board contracted with the prior law firm, on a majority vote of the Board. Oddly, the mayor did not include this damning evidence with his lawsuit -- wherein the motion to hire a new law firm was NOT subject to his approval, but was a Board decision. There is not one word in the minutes that reflect the Mayor moved to appoint any law firm and that the appointment was his to make subject to the approval of the Board! He ignored those facts, much like he ignores the majority of the Board or the law things don’t go his way.
It’s also interesting that the same Mayor that repeatedly claims we have spent enough money on lawyers commenced this lawsuit with the full knowledge that the Village will be responsible for the cost of defense for both the individual Trustees as well as the incorporated Village. Moreover, the Mayor and his lawyer say that the Village should pay for their costs in filing the lawsuit.
Not satisfied with wasting enough of the taxpayers’ money, it gets even better. Now Joe Gross’ lawyer alleges there is a conflict for a single law firm to represent the Village and Trustees for the defense. Had this not involved taxpayer monies, this would be comical. Unfortunately, it is not. Did Mayor Gross’ lawyer make the same allegation when the one law firm represented both the Village and the Mayor together when each were sued by Mr. Missere? The answer: No. Does the Mayor really want the Village and each Trustee to hire individual attorneys and have the Village pay for four lawyers to defend his reckless action? The answer, clearly, is Yes. His hypocrisy has no limits.
Keep this in mind when you cast your vote this Tuesday: Mayor Gross has proven time and time again, he will not allow the business of the Village or taxpayer money to get in the way of his ego and his personal agenda. Send the Mayor your response to his lawsuit against you, it won’t cost the Village a dime, but will save it thousands!
