Letters to the Editor: Misuse of Public Property?

May 16, 2010

To the Editor:

Walking home from picking up the newspaper on Sunday, I noticed a hand-written screed on two pieces of paper taped to a telephone pole. It featured the usual garbled paranoid rant about second ammendment rights being threatened by the current administration, etc.

Am I correct that this is a misuse of public property? Aside from the moronic and offensive content, what would our streets look like if everyone decided to "publish" their political philosophies on the nearest available telephone pole? I hope the police will remove this nonsense at once.

Comments:

Tom,

Did you ever notice all those staples on the telephone polls? This has been going on as long as I can remember. I don't like it either. I also hate all those darn political signs every election time. I do my best to ignore them but it sure is ugly and usually ends up as garbage on our streets.

Tom, by that reasoning any protest that takes place on a sidewalk is wrong.

Not sure, but I think you could argue a difference between a public gathering and someone using public property to post a sign, poster, etc.

Same intent, but different ways of expressing them. I think lots of municipalities have laws about posting bills, but would never think of prohibiting the exercise of free speech in a public space.

Utility poles are private property. Note CHG&E/Telephone Co. ID plates on them.

Good point, Charles. I hadn't thought of that.
