General News: Judge Affirms Decision Against Cornwall
December 22, 2009
A property owner on Route 32 won another round in his legal battle against the town of Cornwall assessor when a judge denied the town’s request for a summary judgment in the case.
Leone Properties won a decision by a Superior Court judge last July that found that the town assessor did not have an acceptable plan for re-evaluating properties in Cornwall. The town of Cornwall appealed that decision and also asked Judge John LaCava to re-instate its earlier request for a summary judgement.
In a written decision on December 4th, judge LaCava said that the town did not present enough evidence to get him to consider granting a summary judgment against Leone Properties.
The town of Cornwall’s appeal of the full decision that overturned the town’s assessment process is still pending.
Comments:
As I said a complete waste of money. I asked once and I'll ask again, is the Town of Cornwall Assessor a Licensed Assessor or has he ever been one. I think we all know the answer since I asked it once before. You cannot have someone assess a commercial property properly unless he has years of experience in assessing commercial real estate. You don't challenge a valuation unless you have a proper re-evaluation inhand. Waste of money.
