General News: Town to Appeal Legacy Ridge Decision
April 15, 2009
The town of Cornwall board voted Monday night to appeal a decision by a New York State Supreme Court judge that knocked down its attempt to challenge a zoning change by the village of Woodbury’s that would allow the Legacy Ridge development to build 280 homes.
The town, the village of Cornwall-on-Hudson, and the Cornwall Central School district had joined with the Black Rock Fish & Game Club to file an Article 78 petition against Woodbury, claiming that the development would negatively impact their cultural and environmental resources.
Supreme Court Judge John McGuirk ruled last month that the town, the village and the school district do not have standing to challenge the zoning change, leaving the fish and game club as the sole petitioner.
With Monday night’s vote, the town will now appeal that decision. Neither the school board nor the village has taken action on the judge’s ruling.
