At the last Planning Board meeting, The River Bank Restaurant made application to expand, doubling its size, into the former Smith house.
They submitted a survey plan not showing any working floor plans, lighting details, egress, lighting specifics, architectural drawings, etc...not what, according to the Village code or the planning board application, constitutes a complete application.
The Planning Board scheduled a public hearing for December 19, 2007. I do not think it is fair to the general public to schedule this public hearing without the public having all the facts to base its comments on. In addition, I do not believe zoning was adequately addressed. The applicant's own approved site plan shows this property is outside the CBS zone.
The original application required a parking variance, 172-46B, to reduce to zero the number of off-street parking spaces. This variance was granted on April 12, 2004 for up to 55 people. I believe with the newly constructed street patio they have already exceeded that. The current application should require the same variance.
I am not sure what the reason is to fast track this application but I do feel the village has a responsibility to make sure the public has a chance to review a complete application prior to public comments and, even more importantly, address zoning issues. This applicant should be held to the same standards other commercial applicants, including myself, have been held to in the past.

Ray, This is the same guy who, in a public newspaper story, (our own Cornwall Local, February, I think) regaled everybody with the story of how he ripped off the IRS, and then he laughed about it. The rules are for the little people like you and me.
