Update on Municipal Annexation Litigation
On November 5, 2015, Supreme Court Justice Francesca E. Connolly granted a motion filed by the municipal petitioners to prevent the annexation of 164 acres of land in the Town of Monroe into the Village of Kiryas Joel pending the outcome of the municipalities’ lawsuit challenging the annexation as unlawful. The Court allowed the annexation special election on November 9th to proceed, but regardless of the outcome of the vote, prevented the 164 acres at issue from being transferred from the Town to the Village until the litigation is resolved. It is anticipated that it will take several months for the litigation to reach its conclusion.
The municipalities filed their motion to maintain the status quo (no annexation) while their lawsuit was pending and to avoid having to reverse changes that would have occurred if the annexation had taken place but was later found to have been illegal. The Court issued its ruling Thursday evening after hearing argument from the lawyers for the municipalities, Kiryas Joel, the Town of Monroe and the involved landowners on Thursday morning.
