For the past several years the Town of Cornwall has engaged in a dialogue with New York Military Academy, including provision of a letter of intent, about the possibility of purchasing property from NYMA for use as public recreation, open space and other Town purposes. While the discussion is ongoing, and a mutually agreed upon transaction is certainly the Town's preference, the Town of Cornwall has recently also undertaken to explore the possibility of acquiring portions of the NYMA through Eminent Domain proceedings and has undertaken preliminary steps in this regard such as having an appraisal and a survey prepared. Unfortunately, NYMA's officials have refused to allow the Town's surveyors onto the property to conduct the survey despite the fact that the Town has an absolute right under the law to conduct the appraisal and the survey. As a result of NYMA's actions, the Town has no alternative but to commence legal proceedings against NYMA to obtain a court order enforcing the Town's right to have its surveyors enter the property. The additional expenditure of funds and loss of time caused by NYMA's refusal to cooperate with the Town is regrettable.
